1. Acceptance of Terms

By accessing or using Bookworm (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and Bookworm.

2. Description of Service

Bookworm is a software tool that provides AI-powered reading enhancement features for EPUB files that you own and provide. The Service includes features such as AI-generated chapter illustrations, glossary generation, and interactive Q&A.

IMPORTANT: Bookworm does NOT sell, distribute, or provide any book content. We are exclusively a software tool that processes content you already own and legally possess. We do not have any affiliation with any book publishers, authors, or content distributors.

3. User Content and Copyright

3.1 Your Content, Your Responsibility

You are solely responsible for all content you upload, import, or process through the Service (“User Content”). By using the Service, you represent and warrant that:

  • You own the User Content or have obtained all necessary rights, licenses, and permissions to use it
  • Your User Content was legally acquired through legitimate means
  • You have the legal right to process the content through AI systems
  • Your use of the Service does not violate any applicable laws or third-party rights
  • You are not uploading pirated, illegally obtained, or unauthorized copies of any content
  • You accept responsibility for any AI-generated content the Service produces by interpreting your User Content, and you agree not to hold Bookworm liable for the character, tone, or accuracy of those interpretations

3.2 No Ownership of User Content

Bookworm does not claim any ownership rights over your User Content. We do not store, distribute, or share your uploaded books with any third parties. All User Content remains your property and your responsibility.

3.3 Publisher and Copyright Compliance

Bookworm respects the rights of copyright holders, publishers, and authors. Our Service:

  • Does NOT provide, sell, distribute, or facilitate access to any copyrighted book content
  • Does NOT circumvent any digital rights management (DRM) protections
  • Does NOT encourage or facilitate copyright infringement in any way
  • Is designed solely to enhance content that users already legally own
  • Operates as a personal-use tool, similar to a note-taking or annotation application

We assume in good faith that all content uploaded by users has been legally acquired and that users have the right to process such content. Any misuse is solely the responsibility of the user.

3.4 DMCA and Takedown Requests

If you are a copyright owner and believe your content is being processed without authorization, please contact us at [email protected]. Note that we do not host or distribute book content; all content is stored locally on user devices.

4. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account
  • You must be at least 13 years old to use the Service
  • You may not share your account credentials with others
  • You are responsible for all activity that occurs under your account

5. Credits, Payments, and Refund Policy

5.1 Credit System

  • Credits are required to use AI features within the Service
  • Different features consume different amounts of credits based on computational resources required
  • Credit balances are non-transferable between accounts
  • Unused credits do not expire
  • Credits have no cash value and cannot be exchanged for currency

5.2 Purchases

  • In-app purchases are processed through Apple App Store
  • Web purchases are processed through Stripe
  • All prices are in USD unless otherwise stated
  • Prices may change at any time without prior notice
  • All purchases are final upon completion

5.3 No Refund Policy

ALL CREDIT PURCHASES ARE FINAL AND NON-REFUNDABLE.

By purchasing credits, you acknowledge and agree that:

  • Credits are consumed immediately upon use to pay for AI computational resources
  • Once credits are used, the computational costs have already been incurred and cannot be recovered
  • We cannot and do not offer refunds for used credits under any circumstances
  • We do not offer refunds for unused credits, including if you are dissatisfied with the Service
  • We do not offer refunds if you do not like the AI-generated output
  • We do not offer refunds for accidental purchases or mistaken credit usage
  • Purchasing credits constitutes acknowledgment of this no-refund policy

Why no refunds? Each time you use credits, we pay third-party AI providers for computational resources. These costs are incurred immediately and are non-recoverable. Offering refunds would require us to absorb costs for services already rendered.

For in-app purchases made through Apple App Store, Apple's refund policies apply. Any refunds granted by Apple will result in the corresponding credits being deducted from your account.

6. AI-Generated Content

6.1 Nature of AI Output

The Service uses artificial intelligence to generate illustrations, glossaries, and other content based on your User Content. You acknowledge that:

  • AI-generated content is produced by automated systems and may contain errors, inaccuracies, or inconsistencies
  • AI illustrations are interpretive and may not accurately represent characters, scenes, or events
  • We make no guarantees about the quality, accuracy, or suitability of AI-generated content
  • AI output may vary and is not guaranteed to be consistent or reproducible
  • You use AI-generated content at your own discretion and risk

6.2 No Satisfaction Guarantee

We do not guarantee that you will be satisfied with AI-generated content. The subjective nature of AI output means results may vary. Dissatisfaction with output quality is not grounds for refund or credit restoration.

6.3 Content Derived from Your Uploaded Books

AI-generated illustrations, videos, summaries, and other outputs are produced by interpreting content from books you uploaded and you are responsible for. The prompts sent to AI providers are automatically assembled from scene descriptions, character extractions, and text passages drawn directly from your uploaded User Content. You acknowledge and agree that:

  • Every AI prompt the Service issues on your behalf is derived from the User Content you provided. We do not inject external subject matter; the source material you uploaded is the source material the AI interprets.
  • The nature of the generated content is therefore directly shaped by the User Content you provided. If your uploaded book contains violence, adult themes, disturbing imagery, historical atrocities, or other sensitive material, AI outputs derived from it — and the prompts automatically extracted from it — may reflect that material.
  • Bookworm does not pre-screen, review, or approve User Content, the prompts assembled from it, or the AI outputs generated from those prompts. All three are produced automatically by software and third-party AI systems.
  • You are solely responsible for your choice of source material and for any AI outputs, prompts, or interpretations generated from it. You will not hold Bookworm responsible for the nature, tone, accuracy, or appropriateness of AI outputs that reflect the source material you chose to upload.
  • AI interpretations may be inaccurate, inconsistent, or differ from the author's intent. Bookworm makes no representation that AI outputs faithfully represent the source material, its characters, or the author's creative vision.
  • You will not use the Service to generate content that is unlawful, defamatory, infringing, or that targets real persons without authorization, regardless of whether the source material contains depictions of real persons.

6.4 AI Video Generation

The Service includes an optional feature that animates AI-generated illustrations into short videos using a third-party video generation provider. In addition to Sections 6.1 through 6.3, the following applies specifically to video generation:

  • Video generation is performed by third-party AI providers, whose terms of service, privacy policies, and content policies apply to requests routed through them.
  • Third-party providers operate their own automated content-review systems and may reject generated output at their sole discretion. These decisions are made by the provider, not by Bookworm, and we cannot appeal, preview, or override them.
  • If a generated video is rejected by a provider's content review, the credits charged for that generation are automatically refunded to your balance. This is our sole remedy for provider moderation decisions; we do not owe further compensation.
  • Because content review outcomes depend on the third-party provider's current policies and algorithms, which change without notice, we make no representation that any particular scene, theme, or passage will pass review. Acceptance of one video does not guarantee acceptance of another.
  • You acknowledge that generated videos are brief automated interpretations of a single illustration and a short motion prompt. They are not faithful adaptations of the source book and should not be represented as such.
  • Bookworm disclaims all liability for the artistic, narrative, historical, or factual accuracy of generated videos, and for any distress, offense, or perceived misrepresentation arising from AI interpretations of content you chose to upload.

7. Acceptable Use

You agree not to:

  • Upload content you do not have legal rights to use
  • Upload pirated, illegally obtained, or unauthorized content
  • Use the Service for any illegal purpose
  • Attempt to circumvent the credit system or obtain free credits fraudulently
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or attempt to extract source code
  • Use automated systems, bots, or scripts to access the Service
  • Share or resell AI-generated content commercially without permission
  • Use the Service in any way that violates applicable laws or regulations
  • Misrepresent your identity or affiliation

8. Disclaimers and Limitation of Liability

8.1 Service Provided “As Is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8.2 No Liability for User Content

Bookworm is not responsible or liable for:

  • The legality, accuracy, or appropriateness of any User Content
  • Any copyright infringement claims arising from User Content
  • Any disputes between users and copyright holders, publishers, or authors
  • Any damages arising from your use of illegally obtained content
  • Any third-party claims related to content you upload or process

8.3 Indemnification

You agree to indemnify, defend, and hold harmless Bookworm, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your User Content and your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including copyright
  • Any claim that your User Content was illegally obtained or infringes on third-party rights

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKWORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

8.5 Third-Party AI Providers

The Service relies on third-party AI providers (including but not limited to providers of large language models, image generation, and video generation) to produce AI outputs. Bookworm is not liable for:

  • The content, accuracy, tone, or appropriateness of any output produced by a third-party AI provider, including outputs derived from content you uploaded.
  • Any content-moderation, safety, or policy decision made by a third-party provider, including rejection, filtering, or modification of generated content.
  • Availability, downtime, rate-limits, pricing changes, feature removals, or quality changes by third-party providers.
  • Any data handling, logging, training, or retention practices of third-party providers, which are governed by those providers' own terms and privacy policies.
  • Any claims arising from the combination of User Content you uploaded and outputs produced by third-party AI providers, including but not limited to defamation, misrepresentation, moral rights, right-of-publicity, or copyright claims.

Your use of AI-powered features is at your sole risk. By using those features you consent to the routing of your submitted prompts and referenced materials to third-party providers strictly to fulfill your request.

9. Third-Party Services

The Service relies on third-party AI providers and payment processors. We are not responsible for the availability, accuracy, or policies of these third-party services. Changes to third-party services may affect the Service's functionality without notice.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:

  • Violation of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Suspected copyright infringement or use of pirated content
  • Extended periods of inactivity
  • Any other reason at our sole discretion

Upon termination, all unused credits are forfeited and non-refundable. You have no right to any compensation for unused credits upon termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. We will notify you of material changes through the app or by email. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in California.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Bookworm.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bookworm regarding the Service and supersede all prior agreements or communications.
